Another rail safety worker prosecuted for failure to provide a sample when drug tested
ITSR prosecuted the worker under the Rail Safety (Drug & Alcohol Testing) Regulation 2008 for the offence which occurred at Sydenham Signals Depot on 16 November 2011.
The worker pleaded guilty, was fined $800 and ordered to pay court costs under section 9 of the Crimes (Sentencing Procedure) Act 1999 when the matter was heard at the Downing Centre Local Court on 14 June 2012.
The magistrate stated that the safety of railways depended on rail safety workers such as the Defendant discharging their duties free of the influence of alcohol or drugs and cooperating with the drug testing regime.
A rail safety worker engaged as a shunter was convicted and fined $2000 on 9 May 2012 for also failing to provide a urine sample.
